I saw a question the other day on a forum I help moderate. It was from a copywriter that was upset because his client expected to receive the copyright of the text. The copywriter thought he would be the one who kept it. The question was, “Is this standard procedure?”
Some writers retain the copyright and just issue a license for their clients to use the text for X period of time. Others transfer the copyright to the client permanently. In the cases of direct mail sales letters, contracts are often drawn up where the writer receives royalties, percentages of sales and other benefits.
As you can see, it’s entirely up to you and your client. Most clients expect to own the copy after it has been paid for. If you choose to offer different terms than the standard, you would be wise to make it known to your client before you begin work to avoid any conflicts down the road.

Great article Karen. I’m currently reading a book on Copyright, Trademarks, & patents. The author clearly points out the importance of identifying my rights to obtain the copyrights of any intellectual property I’m affiliated with. I’m really looking forward to working with you.
Thanks Chuck. Yes, even though so many people swipe content online, it’s really important to make your rights known in case you have to file a DMCA complaint to have stolen content removed or worse.
Excellent article, Karon! In the header of my Word templates, I have the copyright symbol next to my company name. In my contract, I have “Permission for copyright use will be granted when balance is paid in full.” Only occasionally — when lawyers get involved — has anyone requested full copyright.
